My friend's house is for sale with a sales agent. He is not satisfied with the agent, because it seems that there is hardly any result. According to NVM rules, the owner of the house for sale is not allowed to take action himself and the selling agent receives the commission if the house is sold. At the moment my friend has permission from the selling agent to offer the house on Marktplaats, to increase the chance of a sale. My friend wonders whether, if the house is sold via Marktplaats and he carries out all the work himself, the brokerage fee will still go to the estate agent (even though the estate agent has not carried out any work) or whether separate agreements can be made about this with the sales agent?Lawyer
It is advisable to make further agreements with the sales agent about the brokerage fee when selling the house yourself, if this is not apparent from the existing contract.
