Issues regarding service housing | Legal Aid Office

Questioner

I am asking this question on behalf of our denomination. Situation: Our sexton couple intends to resign from their duties because they want to buy a house. If we succeed in finding successors, it is clear to us what we have to do. That is different if we cannot (yet) find successors. What possible limitations should we take into account? It seems that the house is not registered as a service residence at the land registry. We have been advised to also inquire with the municipality of Haarlem whether or not it is registered as a service residence there. Are we free as owners to rent the house to whomever we want? So he/she who has no connection with us as a Church. Why is a service residence registered? The tax authorities describe what they see as a service residence and do not state that such a residence must also be registered as a service residence. Yours sincerely.

Apart from your question about the service residence, I think that there may also be municipal regulations in the zoning plan that interfere with your plans. It may be that the residence in question is marked with a special function, please check that. Then you will also see directly what the regulations are for the service residences.
