Self-Employed: Legal Advice for Part-Time Entrepreneurship

Questioner

I have some questions regarding part-time entrepreneurship. I am currently employed. Now I want to start working as a self-employed person from January (part-time for the time being). My contract states that 'except with the prior written permission of your employer, it is prohibited during the employment contract to perform work - paid or unpaid - of any kind, for yourself or for and/or on behalf of third parties. Does this also apply to work in my private time? And am I obliged to report this if I perform work in my private time? How hard can my employer go to say “no” and stop it? If I want to work one day less, am I obliged to indicate the reason? (even if it is to work as a self-employed person)?

Unfortunately, depending on your agreement, your employer may require you to comply. In principle, such a clause is not valid with a temporary contract. What you can do best depends on the wording. I I have experience with that.
