Contractor liability: Shifts in the garden?

We bought a new house a year and a half ago. When we bought it, there was a lot of water in the back garden and back path. The contractor solved this by installing drainage in the back path. There used to be a ditch in the back path. Now, within a year and a half, the back garden and the adjacent back path have sunk about 25 centimetres. Can we hold the contractor liable for the subsidence in the garden? Should the contractor have pre-loaded the ground? That was done at the house, but not in the garden.Lawyer
