As a potential buyer of a home, am I legally obliged to have the so-called purchase and transfer contracts drawn up and processed by a so-called contract notary (in my case, a choice of two offices) (designated and/or appointed by the selling broker)? Or do I, as a buyer, even in the above-mentioned case, still have the freedom to choose a notary myself?Lawyer
In principle, the buyer has the choice of the notary. This is different if there is a 'project notary' or an 'estate notary'. In that case, the seller can determine that this notary will take care of the delivery, possibly in collaboration with the buyer's notary. The mortgage can always be done at the buyer's notary; there is no obligation to use the estate notary or the project notary.Lawyer
