Repay Healthcare Allowance? Get Legal Advice

Questioner

I received a letter that I have to pay back my health care allowance for 2015. I never received any amount for this and never requested it myself. It appears to have been deposited into my mother's account, who never mentioned this to me. On the internet I see that the tax authorities are no longer allowed to transfer allowances to an account that is not in the name of the person themselves. What are my rights in this case?

If you have not applied for and received care allowance, you cannot repay it. Your mother will then have to repay if she does not meet the conditions. However, you can then apply for care allowance yourself. For further assistance, you may contact me directly if desired.

The case may be a little less simple than Biharie suggests. Did your mother use your DigiD? Have you ever received a message from the Tax and Customs Administration, Benefits Department (BDT)? Could you have known that your mother was using your data? Were you entitled to healthcare benefits? Have you ever given your mother's bank account number to the BDT? In short, there are still a number of questions to be answered before a responsible response can be given. I therefore advise you to contact a lawyer affiliated with the Specialization Association of Social Security Law Lawyers as soon as possible.
