Questioner

Hello, I know that a report has been filed against me, the report is about domestic violence / simple assault. What exactly is going to happen now? I do not agree with it. I have not heard anything from the police yet. Can someone explain to me what is going to happen now?

Lawyer

Dear questioner, the police will draw up a report of the complaint. You as a suspect will receive an invitation to come to the police station to be questioned. A report will also be drawn up of this questioning. The reports, and possibly statements from witnesses, will be sent to the public prosecutor. He will decide whether you will be prosecuted further. If you are not prosecuted further, you will receive official notification of this, if you are prosecuted further, you may receive a summons to appear before the judge. It is also possible that you will receive a call for a so-called TOM hearing. In both of the latter cases, it is wise to engage a lawyer. He/she can request the file from the court on your behalf, on the basis of which the defense can be determined. Many lawyers work via the system of subsidized legal aid (pro-deo lawyer). Your lawyer can check for you whether you are eligible for subsidized legal aid. Good luck with that.
