Extension & Easement: What Are You Allowed To Do?

Questioner

We want to build an extension at the back of the house. Now, the easement of Inbalking, anchoring, substructure and overbuilding is stated in our deed with the condition: a. an extension to a depth of max. 3m measured from the front facade of the house to be built on the dominant property, indicated in the specifications as the basic situation. c. the extension on the serving property of the outer cavity wall that forms the boundary of the extension mentioned under a. with the serving property up to a width of 30 cm. Are we allowed to place our extension on the property line or not? Or do we have to be 30 cm away from it? The wall between us and the neighbours is 30 cm, and our property boundary is exactly in between.

It is not really clearly formulated. As I read it, the wall of the extension must be entirely on your own land (i.e. against the property boundary), but you may build an overhang (for example a gutter or roof overhang) that extends a maximum of 30 cm above your neighbours' land.
