Liability of pedigree dogs: free legal advice
Questioner
Hello, we recently had a puppy walk into our hearts......it is a pedigree dog with a pedigree. The papers were all in order. During the first check-up at our vet, he immediately noticed a loud heart murmur and further investigation was the advice. Ultrasound showed that our darling has a genetic congenital heart defect. This loud heart murmur was not heard during the examination that precedes the issuing of the animal passport. Who can/should we now hold liable; the vet or the breeder and can someone help us with this because we cannot pay for a lawyer from our own resources.....please help?Lawyer
Assuming that you have fulfilled your duty of investigation and you could assume the seller's duty to inform, you may assume in the purchase agreement that the purchase of the puppy must meet the requirements that can be set for a dog. If this is not the case, you can hold the breeder liable for the actions regarding the failure to carefully test the puppy. You can send him a letter in which you ask for another puppy or want your money back, failing which you will take legal action. If you cannot reach an agreement, you can contact me directly and free of charge.Neem de volgende stap
