In September 2013 I bought my house. In December 2014 I was told by the VVE that the balconies in front and back of the entire apartment building were rejected. This inspection had to be done after the disaster in 2011 with the balconies in Leeuwarden. The VVE knew this but officially received the order from the municipality in 2014. My monthly contribution to VVE is 320 euros per month, including building, water and heating. The VVE is healthy and the flat consists of +/- 110 families. Now we have to pay 8000 euros per family this year in one go for the costs of balconies. My question to you is; Can I put VVE in default because they knew since 2011 that a building inspection of balconies was coming? And did not inform me during the purchase, I bought the house in an excision sale from the bank. I hope you have an answer for me because this doesn't really make me happy. Yours sincerely,Lawyer
This information must be provided to you by the seller. I understand that you obtained the apartment from a foreclosure sale. In that case, the bank is not your counterparty, but (as a rule). It is possible that the bank was negligent in providing information, and you can hold the bank accountable for this. But in my opinion, you cannot blame the VvE. The VvE is not obliged to actively provide information for the benefit of potential buyers of an apartment. That would also be a hopeless task.Neem de volgende stap
