Neighbor's liability: What now?

Questioner

A neighbor reported assault to the police. However, I was acquitted by the police judge. I had to incur costs for these; including hiring a lawyer. Can I hold the neighbor liable for these costs and how should I go about this?

Lawyer

No, it is not possible to hold your neighbor liable for the costs. Filing a report is in principle not an unlawful act. It is also not your neighbor who initiated the criminal proceedings, that was the Public Prosecution Service. However, you can receive compensation for damages in the event of acquittal on the basis of articles 89 and 591a of the Code of Criminal Procedure. You must then file a petition with the Court within 3 months. For more information about this, you can contact your lawyer.
