Wheel clamp removed? Legal advice for students
Questioner
I had to rush to school yesterday and due to a lack of parking spaces I parked my car in a parking lot where several garages are located. When I came back I saw that I had a wheel clamp and that I had to pay 160 euros immediately if I wanted to remove the wheel clamp. I then looked at the entrance of the site to see if there was a sign with a wheel clamp regulation and yes, unfortunately there was one. A wheel clamp regulation applies to unauthorized access. Now the wheel clamp was placed by a security company and the parking lot is easy to enter for all cars, although the sign did say that it is private property. I am still a poor student and I do not have the money immediately to have the wheel clamp removed. So my question is, is this wheel clamp legally valid? And if so, do I have to pay the amount in one go or is it also possible to pay afterwards?Lawyer
There are companies that offer companies to place wheel clamps on illegally parked cars. The amounts are often too low to make a lawsuit out of it, but I think it is not allowed to place a wheel clamp without permission, not even if it is announced with a sign.Questioner
Do you know what measures I can possibly take?Lawyer
Is your car still in the parking lot? If so, you should hire a lawyer to summon the removal of the wheel clamp and, if necessary, demand that the wheel clamp be removed in court. I understand that you have a low income as a student. You can then be assisted by a lawyer who works on the basis of legal aid. You then only pay a personal contribution.
