Liability for Damage caused by Children | Legal Aid
Questioner
A child 9 years old cycles on the public road and drives into my stationary parked car. Damage more than 500 euros. Mother, after data noted, does not respond. Who is liable? I do have a witness statement from someone else.Lawyer
In this case, the parents are liable and obliged to compensate for the damage. The statement has added value in court. I would be happy to draw up a liability statement for you.Lawyer
Parents are indeed liable for the damage to the child. You or a lawyer can write to the parents of the child and put them in default for the damage that her child has caused. If the parents do not want to pay this and do not continue to give them at home, you can submit the case to a judge. I also advise you to inform your own insurance. They may also be able to help you with this. If you would like further help and/or advice, please feel free to contact me.Questioner
Thanks for the responses so far. Note: at Univé legal expenses insurance they told me by phone that a stationary car is participating in traffic and therefore a cyclist/a child is not liable???? At my insistence they would investigate it further... Strange turn in this story. In the meantime, after three days, mother has sent a message, submitted the case to her intermediary. I think I will not wait much longer for that and officially hold her responsible by letter?Lawyer
Anyone who commits an unlawful act is obliged to compensate for the damage. It is not the case that road users are excluded from liability. I have drawn up a liability statement for you. Please contact me for this.Neem de volgende stap
