I have been living in a student complex for a month now. This complex has been converted into studios. Because this renovation has not yet been completed, the closed bicycle shed has not yet been built. As a result, I am forced to park my bicycle next to the entrance of the complex, on the public road. Last weekend my bike was stolen, even though it was secured to a fence with both a bicycle lock and a chain lock. I already pay the full rent and if my bike had been in a locked shed the chance of theft would have been considerably smaller. Because the bike has a new value of almost €1000,-, I want to see if I can hold the landlord liable and recover the damage from him. After several hours of searching on the internet, I have not yet found any clarity on whether I can indeed hold the landlord liable for the damage, what steps I need to take to do so and whether I can recover the damages from him.Lawyer
If you pay for a storage space, you can also assume that the storage space is present or will be made as soon as possible. The landlord is therefore liable for the fact that you cannot use a storage space and that you have suffered damage as a result. You or a lawyer must therefore hold the landlord liable for the damage you have suffered because you cannot use a locked storage space while you have paid for it.
