Liability for hidden defects
Questioner
Mid-September 2015 I got the key to my house. After moving I heard noises every now and then but thought that these were 'part of the house'. Now it turns out that there is a rat problem in the house that can only be solved structurally by removing the entire floor (high costs) and perhaps even replacing the sewerage. According to the neighbors this problem had been going on for a while and the sellers were aware of it but did not report it. My question: Is this a hidden defect and can I hold the seller liable?Lawyer
Yes, a serious structural problem is a defect in the rented property and the landlord must resolve this at his own expense.Questioner
Thank you very much for the answer. However, it concerns a purchased house and not a rental house. My question is whether this concerns a hidden defect for which I can hold the seller liable.Lawyer
Yes.Lawyer
You can hold them liable and give the seller a period within which they can solve this defect. It is also not a hidden problem because it is clearly visible and therefore deliberately concealed. If you need further help, you can always contact me directly.Lawyer
First of all, how annoying for you that you have a rat problem and that this can only be solved by removing the entire floor. I understand that the sewerage probably needs to be renewed as well. Solving this problem will of course entail high costs We understand that you have been affected by the fact that the seller of the house did not report this to you in September 2015 - this is a hidden problem and was clearly deliberately concealed from you. I would like to know a little more about your case and perhaps we can offer you the opportunity to address your issue in our program. I am working for the new SBS6 television program 'Meester Frank Visser doet Uitspraak' in which Mr. Frank Visser resolves high-profile issues and conflicts. You may know Mr. Frank Visser from the TV program 'De Rijdende Rechter' (started by him over 20 years ago because he believed that all people have the right to justice. And he still believes so!) If you are interested, please do not hesitate to contact us, we may be able to help you. If your 'problem' has now been resolved - then we are of course happy for you!Neem de volgende stap
