Car Liability: Discover Your Rights

Questioner

I bought my car on 17-03-2014 from a garage. The odometer read few km 35000. I specifically asked if the car was damage-free. The garage owner told me that the car was damage-free. I also requested the history of the car via the internet for a fee, which also showed that the car was damage-free. Finally, I also contacted the Peugeot garage where the car was sold new and had always been serviced, they also told me that no damage was known. I recently had a leak in my trunk. I went to the garage and they investigated it. I was told that the side of the car was badly damaged and that it had been repaired poorly, they had filled and sealed everything, if I have this repaired it will cost me 4500 euros. The garage told me that this is a hidden defect that has been deliberately concealed, after all, nothing can be seen on the outside. It was almost 2 years ago, I can hold the garage liable for this. Kind regards,

You can hold the garage liable if you have good evidence that the damage occurred at the time of purchase at this garage and that the seller concealed the damage. Now that the seller states that there is no damage, you can assume this statement and you must sufficiently prove that this is not the case. If you succeed in doing this, there is a reasonable chance that you can successfully hold the seller liable.
