Liability for hidden defects

best, I bought a house some time ago. My purchase contract included a questionnaire that also asked whether there was (or had been) moisture penetration or rising damp on floors, ceilings and/or walls. The seller had indicated that this had indeed been the case in the bedroom, but that it had been resolved in 2013. When I moved into the house, it was indeed visible in the bedroom that this had been the case, there were spots in the wooden wall. Since this had been resolved according to the previous occupant, I decided to replace the entire wall so that it would be a neat whole again. But now I have moisture spots in the same spot in my new wall. So the problem had apparently not been resolved. Now my question is: Is the previous occupant liable for this?

If you have fulfilled your duty of investigation and the hidden defect has been reported by the seller but according to you has not been sufficiently repaired, then you can hold the seller liable for this.
