Landlord's liability for mold problems
Questioner
I live in a rental house, ground floor, 2 rooms and a front and back garden. From the first day we lived here (26 April 2013) we have complained about damp and mould. The landlord (housing association) sent someone to look, this resulted in making two holes in the outside wall, which reduced the damp problem, but not the mould problem. Our wardrobe is against the outside wall and all clothes smell of mould and damp and there are also mould spots on the clothes. My question is, can I hold the landlord liable for the mold on the closet, in the closet and on the clothes? As a landlord suggested, not putting the wardrobe against the floor was a stupid solution, because in a 2-room apartment you have few options to move things.Lawyer
If the mold problem is caused by a defect in the home and this is attributable to the landlord, you can hold the landlord liable for it. Regarding mold on clothing, in and on the closet, compensation may apply for consequential damage. This depends on the circumstances and the provisions in the rental agreement.
