Liability for damage caused by a truck
Questioner
Our car was parked in a parking lot. When we arrived, there was a passenger car behind us. When we returned 2 hours later, there was a truck parked behind us. It was so close behind us (3 cm distance) that we checked to make sure we had no damage. And yes, damage. In our opinion, clearly caused by a protruding part of this truck. So clear photos were taken, with both license plates of course. The next day I found out who this truck had been rented to and contacted this man. His reaction was strange. At first he seemed to agree with us, started measuring everything etc. Then it turned out that he didn't want anything through the insurance. Well, fine. He offered us an amount of €50. We said that we first wanted to find out how much the damage would cost and the gentleman agreed. Damage turned out to be €450. When we informed him of this, the gentleman suddenly became defensive and said that he absolutely believed that he had not caused the damage and therefore did not want to pay for it. What should we do now?Lawyer
You must hold the insurer of the truck liable for the damage, providing evidence. If he does not want to arrange anything through the insurer, you must hold him personally liable. For more information, you can contact me directly and free of charge.Neem de volgende stap
