Fall Protection Liability: Discover Your Rights

Questioner

Dear, As a facility coordinator, I am responsible for the management of two office buildings for our organization. Fall protection facilities have been installed on the roof of our office in the new construction. When our own caretaker has to be on the roof for work, he wears a harness and secures himself to the designated safety lines & points. Now there is a supplier of solar panels working on the roof and I see that they are not using this fall protection. What about liability if an accident occurs? Are we liable for this? Am I as a building manager or is our supplier liable in this because his own staff does not use the fall protection? Thank you in advance for your response. Yours sincerely,

It is quite possible that the supplier does not adhere to safety guidelines towards his employees. If you see this, you must warn and preferably in writing. Liability can never be completely avoided, not for the client, employer or building owner, building manager. In the case of obvious violation of rules, it should definitely be discussed.
