Who will take over the house after a breakup?

My ex-partner and I separated last year. She moved with the children to a place nearby, and I continued to live in our house. Unfortunately, there was a lot of disagreement about everything and anything, and so now, 14 months later, we have finally reached the point where we have had an assessment for the National Mortgage Guarantee, as the house has negative equity. The assessment showed that I could take over the house, but she could not. Now that it has become clear to her that I could claim from her because of the negative equity of the house, she has indicated that she wants to take over the house together with her new boyfriend. How is it now determined who can take over the house in this case? As mentioned, she has been living elsewhere with the children for 14 months and has never spoken about this before.
