Liability and compensation for dog incidents
Questioner
After a fishing session, a dog broke my fishing rod while I was cleaning up the gear and damaged it beyond repair. This is a fishing rod from 1985, old but in very good condition. There are no spare parts available for this rod. The rod cost 550 guilders at the time. A replacement new rod of comparable quality now costs over €500. The owner of the dog does not want to support a claim on his third-party liability insurance and is now offering me €50 in damages..... I am now going to formally hold him liable. Not so difficult, because the area in question is forbidden for dogs and the dog was not on a leash. But what is a realistic amount of damage in such a case? And what should I do if he does not respond to my notice of liability?Lawyer
The current value of the fishing rod will have to be reimbursed. This is also used in legal cases. This means that I think the proposal is reasonable and that there is little point in formally approaching the liable person. Perhaps it would be better to negotiate.Lawyer
