Who is at fault in a traffic accident?
Questioner
I had to give way to a car at an intersection. I didn't see the car at all because it was driving without lights in the middle of the night. A collision between the cars was the result. Fortunately no injuries but there was bodywork damage. After the accident the police and ambulance were all there. The other party had 4 per mille alcohol in his blood. There is also a witness statement that the other party was driving without lights. I haven't heard from the insurance company yet, but I'm wondering who's to blame for the accident?Lawyer
Although you are in violation according to the traffic regulations, the facts of the other party weigh more heavily (no lighting, alcohol). In addition, you have a witness so that you can strengthen your innocence. Based on this, I expect that the other party will be seen as guilty. It is unfortunate that you had an accident. Considering the circumstances; alcohol and no lights, I expect that a large part of the blame lies with the other party. However, if I were you, I would not assume that you are completely free. After all, you did not give way. In addition, it is important how well the intersection was lit and how well you could have seen the other party.Neem de volgende stap
