Who is responsible for the riser? | Legal Advice Centre

Questioner

Who is responsible for the riser? Our VVE consists of a number of apartments, the standpipe that supplies us with water is in the adjacent building which is not part of our VVE. Now there are leakage problems at the riser, in the adjacent building (so not in the apartments of our VVE). Is our VVE now also responsible to tackle these problems? and to contribute to repairs to the riser?

Lawyer

The owner of the adjacent building is liable for the damage. However, the board of the VvE should quickly address this and write to the owner of the adjacent building and hold him liable for the water damage with the request to have the leak repaired as soon as possible (of course at the expense of the owner of the adjacent building). This letter could also state that if no action is taken within x number of days, the VvE will have the repair carried out at the expense of the neighbor. Of course, this is only possible if the pipe can be reached from the complex itself. If the adjacent building has to be entered, the cooperation of the neighbor is required.
