Unemployment benefits rights when extending a contract - Legal aid centre

Questioner

Situation; Fixed-term contract (2nd year contract) expires on October 1. Employer will either switch to permanent employment or not terminate contract. With the latter option there is no problem with regard to the WW application, how is that in the first case? So employer wants to extend contract, employee not because of working conditions and wants to apply for unemployment benefit after WW. If new appointment is refused, do you as an employee have sufficient rights to apply for unemployment benefit?

Lawyer

If the employer offers you a new contract and you refuse it, then in principle you are not entitled to unemployment benefits (culpable unemployment or detrimental act). There must then be very good reasons to refuse that new contract. Therefore, first consult a specialized lawyer before you refuse. Otherwise you may get into trouble. If the employer does not extend the contract, you will in principle receive unemployment benefits. After all, you meet the weekly requirement.
