Veterinarian Liability: What to Do?
Questioner
My dog had surgery last year at the vet, he had a small tumor in his nose. The vet operated on my dog, but when I went to another vet for a second opinion I was told that the operation that had been performed could not be done yet because they were still investigating whether it was possible. 4 months after the operation he had a tumor back and after 6 months he died. Now I want to hold the vet liable, can I do that and how should I do that?Lawyer
The question is also how old your dog was in addition to the issue of whether the doctor made a mistake, because as bad as it sounds: after the liability phase you can only claim back the current value of the dog and the treatment costs. Moreover, the doctor can only be held liable if his/her decision was wrong, not in accordance with the professionalism that may be expected. The defense that you would probably also get is that your dog would have died anyway.Questioner
My dog was just 10 years old, and he said the surgery was possible. because he estimated the dog to be 5 years old. and I called the pet disciplinary committee and explained the story, and they indicated that they should not leave it at that.Lawyer
That is a serious mistake, but if you are concerned about financial compensation then my answer above applies, if it is a matter of principle then you can help by drawing up an official complaint.Neem de volgende stap
