Bank liability: Your rights in the event of mortgage problems
Questioner
In 2008 we received a mortgage from ABN AMRO. My husband was self-employed in construction without disability insurance and was not referred to the NHG, truthfully stated that he had had a heart attack in 2005. I worked part-time as a permanent employee. In 2009, disaster struck, my husband was paralyzed in the wrist and the construction industry was in deep recession, contractors who did not pay, I was fired. Until the end of 2013 we were able to pay the mortgage with great difficulty. All our savings and annuity were used up. In January 2015, the house was sold by the bank, we now live in a rental property but have a residual debt of €88,000. And we are in danger of ending up in debt counseling. My question is, can we hold the bank liable or in default? Thank you in advance.Lawyer
In some cases that is possible, to be able to judge this I would first have to look at all the pieces and judge. If there is unnecessary selling or the bank has dropped stitches that is certainly possible.Lawyer
