Dog Liability: What to do in case of damage?
Questioner
My dog was attacked from behind by another dog 20 meters from our house and has serious wounds on his back legs. The owner considers this his own risk because my dog was also running loose. I wanted to file a report but the police said they couldn't do anything, there was no criminal law involved. We have a hefty bill from the vet, 250 euros and the owner does not want to pay anything. I think he does not take his responsibility and just lets a dangerous dog run loose in a residential area. what can i do? Kind regards, PLawyer
You must hold the owner liable in writing by registered mail for the damage caused by his dog. As the owner, he is in principle liable by law for the actions of his dog. It is still possible that if the damage is to be compensated, there may also be a question of contributory negligence; this depends on the facts and circumstances. If the owner (or his insurer) refuses to compensate for the damage, I advise you to hire a lawyer. You may also contact me directly and free of charge for further consultation.Questioner
Dear B, thank you for this response, as soon as all veterinary costs are clear I will follow this advice. I hope that the police will continue to monitor whether this unreliable dog does not cause more/human victims.Neem de volgende stap
