Holding a trustee liable | Legal aid centre

Questioner

I have had a trustee since April last year, and now this trustee has made a mess of things. I am normally entitled to special assistance for the costs of the administrator. Now last year my benefits stopped because the administrator had not changed my address with the municipality, she had said that she had to do that herself instead of me. Apparently my special assistance was also stopped then. Apparently she didn't know that she had to reapply for special assistance when my benefits were resumed. Now that I have started living together, my girlfriend has found out that I have not received any special assistance since June, and the administrator now says that she can no longer reverse it because it is too late. I also indicated in February that something was wrong, and she said at the time that it was not a priority and that it would be rectified later. So now I have not received any special assistance for 7 months due to her negligence. Is there perhaps a possibility to hold her liable for this? We are already in the process of getting another administrator. Yours sincerely,

If the administrator makes mistakes that harm you, the administrator can be held liable for this. Based on your story, it can be concluded that the administrator made a mistake, except for the agreements made or new facts. You can then hold him/her liable for this. If liability is denied, you can start legal proceedings.
