Legal Obligations for Soil and Pit Problems
Questioner
I have just moved into my new home. now. the house is built on a plan that the project developer still owns. Our plot is on a corner in the inner bend of the street and the height difference between the level of the house and the street is approximately 60 cm. a green strip is planned along the street that is still owned by the project developer. The width of the green strip is 1.1m. Now our driveway is placed on a piece where a rainwater drain is placed on the edge of the green strip and my plot. If I measure it from the house, the drain is just a little bit on my plot and the project developer says that the drain is on his land. at the moment I have dug open the drain but due to the height difference of 60 cm, the drain is approximately 30 cm below the surface of my driveway. so there is a deep hole. my questions are as follows. Assuming the well needs to be moved, who is responsible for the costs of moving the well in the event that the well is located entirely on the project developer's land. Assuming the well needs to be moved, who is responsible for the costs of moving the well in the event that the well is partially on my land? What happens if I do nothing and fill the well? Dangerous situations will arise in the winter when the water cannot drain away and a large ice rink will form on it. If you have any questions or would like to receive situation photos/drawings, I have them ready for you. Yours sincerely,Lawyer
Good afternoon. If the well is actually on your land, this is your responsibility and otherwise it is the responsibility of the project developer. If you want to be sure about the boundaries, you can consult the land registry and ask for clarification. I am of course always prepared to take a look at the situation using the drawings. You can contact me for this.Neem de volgende stap
