My father's will refers to his partner as executor. She has since passed away. If my father passes away, will the task of executor automatically pass to his partner's heirs?Lawyer
No. Your father must appoint a new executor in his will. Perhaps there is already an arrangement in your father's will in case his partner does not want to be appointed executor or - as is now the case - cannot accept the appointment. There is no legal regulation that allows the function of executor to fall to the heirs of the partner. So if your father has not arranged anything else, there is no executor.
