Legal advice on final salary settlement
Questioner
My contract has not been extended with my old employer. My last working day was March 5. Now I have received a letter that I have to sign an agreement for final discharge, after which they will pay my final settlement. Is this allowed?Lawyer
The employer cannot demand this from you. He must simply proceed to the final settlement, even without you signing for the final discharge.Lawyer
Have you had access to the final statement? In other words, do you know how much you get and how it is calculated? Your employer cannot demand this of you, he is obliged to draw up the final settlement on time and to make it right. If he does not do this, you can claim interest on it and if necessary go to court. You can contact me to discuss your case and take action if necessary.Questioner
Thanks for the comments :-) I was so bold as to call and send an email to confirm. They would proceed to payment. I'll wait and see, otherwise I'll still call on you. In addition to the final settlement letter, there was also a pay slip. Yours sincerely,Neem de volgende stap
