Liability for damage caused by a landscaping company
Questioner
A question on behalf of my neighbors. My neighbors recently had a fence installed by a landscaping company, together with the other neighbor. During the excavation work, a large power cable was cut and the electricity company had to come and repair it, leaving the entire street without power. Now my neighbors, as well as the other neighbors, have received a hefty bill for this. My question is: shouldn't this be paid by the landscaping company itself, shouldn't they be insured for this?Lawyer
The damage to the cable was caused by the gardening company, so they are liable for the repair costs. Your neighbours should hold the gardening company liable by registered letter. If the company is insured, which is usually the case, the costs will be reimbursed by their insurer. I am happy to draw up a claim for them. If desired, your neighbours can contact me for consultation free of charge and without obligation.Questioner
Thank you for your quick response. I will show my neighbors your answer, and then they will have to take further action themselves.Lawyer
