Sickness Benefits Act and Legal Aid - Legal Aid Seekers
Questioner
On 10-01 my friend's sickness benefit was to be terminated due to the first-year assessment (we are objecting to this because he is still being treated at the hospital for his complaints on his left side and is still in a lot of pain). On 08-01 he fell down the stairs, causing several severe bruises on his right side (hand completely swollen, back completely blue, foot swollen, etc.). We then had to create a new sick leave notification and were told that this would take effect on 12-01 because there was no other option due to the first sick leave notification. He would then have to be called up again by a doctor. The doctor refused this and was told that he was not legally allowed to do so. Nevertheless, he stuck to his position and now the sickness benefit is being rejected, because the doctor simply says that my friend is making a fuss and that he is protesting against the assessment of the first sickness benefit. He has not received any payment since 12-01. What can we do about this? A reintegration doctor there says that we are right and that no one agrees with the doctor's decision, because that is not possible. He has not seen my friend, has not spoken to him and has not requested any medical data. I hope that someone here can help us.Lawyer
If there is a difference of opinion about the ongoing illness, you can request a second opinion from the UWV. You will then be called by an insurance doctor and assessed for your symptoms etc. The result of the second opinion determines whether you are still ill. If you require legal assistance in this regard, please feel free to contact me directly and free of charge for consultation.Neem de volgende stap
