Calling in sick after back pain? Your rights and advice
Questioner
I am a high-level athlete and have developed back problems due to my work. After 1.5 months of doing other work, the occupational health and safety doctor I've seen a few times wants to come out. That I will be doing my own work again tomorrow, that is, the work that caused me discomfort. At work, she has been putting a lot of pressure on herself over the past month. The sports doctor and physiotherapist think that my back is not good enough yet and it is also still very painful. So I'm thinking of calling in sick again tomorrow. Because I'm still in pain and also mentally not able to do my job and this also affects my back. FYI, I earn just as much from sports (and therefore also an employer) as from work. My question is can I call in sick again or is that not allowed. What is wise? Thank you in advance for your advice.Lawyer
If you can no longer work due to your back, you would be wise to report yourself sick to your employer again. Also report this to the occupational physician to be on the safe side and indicate that the work is still too taxing for you.Lawyer
If you are ill, you can report yourself as unfit for work. If there is a discussion with the company doctor about whether or not you are able to perform the work, you can ask the UWV for a second opinion. The opinion of the UWV doctor is then decisive. Unfortunately, I cannot answer what I mean because you would need to know all the details. But if you need further assistance, you can contact me directly without obligation. I have extensive experience in the field of employment law.Neem de volgende stap
