Inheritance after death: What to do?

Questioner

if my husband and i have an accident and both die, who will inherit? I have heard that if the last one to die, the inheritance goes to his/her family. and what if both parents are no longer there, does it go to your brother or sister? Can we arrange this ourselves to determine who the inheritance will go to or do we have to go to a notary for this? We are married and own a home.

Lawyer

If you have no children or other descendants, the surviving spouse of both of you will inherit everything. If he or she dies after that, the parents, brothers and sisters of the surviving spouse will in principle be heirs in equal shares. If you wish to deviate from this statutory arrangement and/or if you wish to appoint an executor, you will indeed need to have a will drawn up by a notary. Good luck.

Lawyer

If (for example due to an accident) it cannot be determined which of you died first, you are deemed to have died at the same time. You will not inherit from each other.
