Compensation for dentist error - Legal Aid

Questioner

In April 2014 a cavity was filled in my upper right molar. After this treatment I had a lot of trouble with this molar. To this end I made several appointments to have it looked at, but each time nothing could be found, the appointments were made and so were the invoices. Pain and sensitivity increased weekly. Eventually after the 6th appointment for this molar alone in 6 months a 3D X-ray was taken and the dentist decided that a root canal treatment had to be performed. This is very expensive and is not reimbursed because I already had 6 appointments earlier. Now my question is, can the dentist be held liable for payment of damages because - the root canal treatment had to be performed due to a mistake by the dentist? At the first appointment in April, the filling was not placed properly, causing bacteria to enter the nerves. Why should I pay for something I did not want? Why should I pay for careless treatment and a mistake by the dentist? - and can the dentist be held liable because my tooth and nerve have been declared dead due to his mistake. In total I have spent EUR 700 out of my own pocket (non-reimbursed part). What are my options? Tags: (Dentist's error, carelessness, shortcoming, medical treatment agreement)

Lawyer

The dentist has a so-called duty of care towards the patient. He/she must ensure that he/she, as a reasonably competent and reasonably acting specialist, has exercised the care that may be expected of him/her. If it is established that the dentist has violated his/her duty of care and the damage can be attributed to him/her, then there is a chance that he/she is liable for your damage. At first glance it seems that the dentist made a crucial mistake and was careless. Whether this is the case must be assessed.
