Liability for damage caused by the baker

Questioner

Recently I was at the bakery to buy bread. They have wicker shopping baskets there. The basket I used for my groceries was broken. The handle (made of iron) was partly broken off and was sticking out, which I did not see. Unfortunately, this sharp protruding wire rubbed against my coat and now there is a chafing in my coat. I immediately reported this damage. The owner would call me back about this. She did so idealistically and now they say that their insurance does not cover this damage and that it is my own fault. Now I have spoken to my own insurance and they do not cover the damage either. What are my options in this? Can I still hold the baker liable or is it really my own fault?

Lawyer

If you have damage to the goods of the baker in this case, the baker generally remains liable for this. They must then compensate the damage because sometimes this is covered by their insurance. However, it must be proven that you did not act unlawfully and that you are not to blame, or at least that it is not your fault. You must have evidence (possible witnesses), for example to show that it was a dangerous situation. A letter from a lawyer may provide a solution.
