What to do in case of unwanted donation? | Legal aid centre
Questioner
When two parties (donor and recipient) sign a deed of gift with acknowledgment of debt with good intentions, but are not well informed / not well informed about the consequences thereof; and both parties realize shortly after signing that the deed is unwanted. What can those parties do to get rid of the deed? Can they simply ask the notary to annul the deed? There is no revocation clause in the deed, but neither party wishes to keep the deed.Lawyer
Please explain: has the donated portion been borrowed back, because you are talking about acknowledgment of debt?Questioner
Indeed.Lawyer
You give it away and borrow it back. Can't you just pay back the borrowed amount or is that not allowed under the terms? What is the reason why you do not want this construction (anymore)?Neem de volgende stap
