What to do in case of a tacitly extended contract?

Questioner

Hello, According to my employer, I have had three contracts and my contract will not be extended because they cannot offer me a permanent contract. Now I never received or signed contract number 2 Contract 1: June 2012 - December 2012 Contract 2: January 2013-December 2013 Contract 2: January 2014 - December 2014 I have now requested a copy of contract 2. If it turns out that I have not received this, my contract has been tacitly extended. Is it correct that in the case of a tacit extension, the duration of the previous contract is assumed, i.e. six months? That means that I am now in my fourth contract. I should have received a permanent position last year. What are my rights and what can I rely on? Thank you very much for your response.

It is true that if an employment contract is tacitly extended, this is under the same conditions. So also for the same term. Based on what you indicate, the contract would have been tacitly extended twice and your contract is now the fourth contract. Sometimes you are allowed to have more than three temporary contracts if this is stated in the collective labor agreement. If this is not the case, you are now in the fourth contract and the employer must request permission from the UWV to be able to terminate the employment contract.
