Who is responsible for a damaged package?
Questioner
Day, Yesterday an order was sent to me that I ordered via the internet. A product that was sent as a package. I got it delivered to my door 10 minutes ago by the postman and the product is so damaged that it is unusable. Who is responsible here? The product was very carefully packed. I am very upset about this because at least it's not my fault and it would be unfair if I'm the one who has to pay for this! I look forward to hearing from you. GreetingLawyer
Hello, Thank you for your question. Often the general terms and conditions will state that the seller is not liable for damage that occurs during shipping. If you have been correctly informed of the general terms and conditions, this rule also applies to you. But the seller must be able to prove at all times that a defect in the goods he sends is not due to his conduct. The burden of proof lies with him for the first 6 months. So the seller must first prove that it is not his fault that the damage occurred.Neem de volgende stap
