School liability in case of theft – Legal advice centre

Questioner

My daughter (and 8 other students) her iPhone and iPod were stolen from her coat during gym class at her school. The locker room is always locked but this time the intern forgot to lock the door. Result is that someone from outside went in and took everything. I reported it and the school reported it. Now I hear from the school that they accept no liability for searching for property. Is there anything that can be done?

Whether or not the school is insured for these types of things is irrelevant. You will have to prove that the school was negligent in this case. For example, if your child has a locker at school, she should have used it. If this is not the case, you can try to hold the school, as the employer of the intern, liable in writing - of course by registered mail - for the theft of your daughter's devices. If the school disputes liability, you will have to go to court
