Liability of scooter seller - Legal advice centre

Questioner

I bought a second-hand motor scooter from a dealer in August 2014, the scooter had a license plate, but was never registered in my name. I immediately called the RDW to ask if I could register the scooter in my name again, no problem, just show it to the RDW and the license plate can be registered in my name, because the VIN number was known to the RDW. So I bought the scooter. I immediately made an appointment at the RDW for the license plate, on 27-08-2014 I had to show the scooter, at the RDW they did not completely trust the number that was stamped into the frame and could not approve the scooter for the license plate that day and I had to make a new appointment for an investigation of the chassis number. On 5-11-2014 I had to take the scooter to the RDW again for the investigation, the investigation showed that the number was incorrect, because there were numbers mixed up. The RDW cannot determine the identity of the scooter and therefore cannot give a license plate on the vehicle. Can I hold the seller liable for this or do I have a decorative piece in my garage?

Lawyer

You can certainly hold the seller liable for this because it appears that the scooter was stolen, at least that is what I suspect because the number is crooked. That results in at least mutual error, maximum deceit. In addition, you have purchased an item that has a significant defect, you are not allowed to go on the road with the scooter and it therefore has 0 value. That is a breach of contract. I can help you further with this, please contact me directly?
