Questions about alimony and legal assistance?
Questioner
Ir/Madam, I have been sentenced in Poland to pay alimony for a son from a previous short relationship. I recognize my son, and have been paying since our breakup, but I have been sentenced for a higher amount. My purchasing power has not been taken into account, and my ex has appealed because she wants even more, and every argument in her motivation is a lie, which I can prove with documents. I have no confidence in the lawyer I hired in Poland. I don't feel he is looking after my interests properly. I understand that this is very brief information in a complicated case, but I do need help with this. I do not know what my rights and obligations are, and how I can find a good lawyer abroad. For example, can I bring this case in the Netherlands?Lawyer
A foreign civil judgment can be recognised in the Netherlands by the provisional relief judge and subsequently enforced. Recognition takes place on the basis of the Implementation Act EEX Regulation. In principle, the provisional relief judge recognises the foreign judgment if all procedural requirements have been met. You can appeal against the execution, but not on the merits. I advise you, after you have received the judgment, to make an appointment with a lawyer who specializes in this matter. In terms of content, your Polish lawyer will have to act on your behalf.Neem de volgende stap
