My boyfriend and I recently bought a house and are currently working on getting everything sorted out through a mortgage advice agency. We now understand that the mortgage advice agency submitted the required documents to the bank too late. The bank cannot assess in time, which means we have to request a postponement for the final signing of the purchase contract. If we can demonstrate that we suffered a (financial) disadvantage as a result of submitting the documents to the bank too late, can we recover this from the mortgage advice agency?

Whether the advisor is liable for submitting the application too late depends on what you have agreed with him about this. Were agreements made about when the application would be submitted or did the advisor indicate at any time when this would happen? If so, you can take the position that the advisor has failed to submit the application too late and hold him liable in advance for any damage you may suffer as a result.
