Questions about dismissal and contracts?

Questioner

Dear Sir/Madam, I have a short question. What if someone has a permanent contract and is abroad for a year, which the company has agreed to and she is on unpaid leave but she actually wants to extend her work there for another 3 months. Her employer threatens her to resign because he wants to fill the position. Can this just happen because she has a permanent contract. I would like to hear from you. Kind regards,

Lawyer

There is no right to longer unpaid leave. And the employer does not have to cooperate in this. Not returning on time and going back to work means refusal of work and that is grounds for summary dismissal.
