Legal Advice on Employment Law Issues

Questioner

Hello, I have a question about employment law. I am a fanatic sportsman (football) and unfortunately I often get injured. I work on a work therapy basis. My boss wants me to stop playing football or other sports that can cause me to get injured. Now I have agreed with my boss that I would stop playing football, no sooner said than done. Last time during the carnival holiday I went skiing with my girlfriend. There I went snowboarding and unfortunately injured myself again, which made me unfit for work again. Now I have received a letter from my boss stating that he is suspending my continued payment of wages until I am better again on the basis of art. 629 section 3 sub b book 7BW. Is this allowed?

Lawyer

The main rule in the case as you describe it is that intentional risky behavior (for example snowboarding) cannot lead to the complete suspension of wages or the loss of your entitlement to full continued payment of wages during illness.
