I bought a house together with my then boyfriend and it is in both names. We do not have a cohabitation contract. We are separated and the house is already for sale. However, the situation has now gotten so out of hand that I can no longer get out of it. My ex is taking little to no steps to deal with this while I want to get rid of the house as soon as possible and will do anything for it. As long as the house is not sold, I cannot rent a small house to be able to continue with my life. In the meantime, I am taking medication for my heart because the stress is increasing enormously. I am desperate and feel powerless, I want to continue with my life so much. What I really want: to get rid of the house and my ex!!! Who can help me? What can/should I do?Lawyer
You can also instruct a real estate agent to mediate the sale. If you have found an interested buyer, you can go to court with the request to be allowed to sell the house with substitute permission from the court for the agreed price. Please note that you stipulate with the prospective buyer that the purchase will be concluded under the condition that the court gives permission for the transfer. You will also have to be able to prove that the agreed price is a fair market value, for example by means of a valuation report. If the house yields less than the mortgage debt, you will have to come to an arrangement with the bank.
