What to do if you have debts in your name?
Questioner
I would like to know what my rights are, my ex-partner has made debts in my name. All collection letters have been thrown away and now they are coming to me, which is how I found out. I have my own company, which earns me more than her, it is also partly in her name. Do I now legally have to pay everything because she has less income? I would like to know if I can legally start something since I have always transferred money to her through the bank for the bills or can I do nothing with it?Lawyer
It is clear that your ex-partner has acted unlawfully by creating debts in your name. If this happened during your relationship and you were married in community of property, you will in principle each have to pay half of the debts. If the debts were incurred after the end of your relationship or if you were not married or in a registered partnership, the debts will be for the account of your ex-partner. The problem then is how you are going to prove that you did not agree to the debts yourself.Neem de volgende stap
