What to do in case of problems regarding parental contributions?

Questioner

Dear, I am currently 17 and graduated this year. My parents are divorced. I am going to study next year and according to my mother, during the divorce it was determined what amount I would receive from them monthly for my living expenses. The agreement also states that my mother must give me 45% of that amount and my father 55%. Now my father is making a big deal about it, while according to my mother it is fixed what amount he must give me monthly. If we cannot reach an agreement, I am prepared to settle it through the court... now my question is what are my options? Yours sincerely.

Once you are 18, your own income and any student finance will count. The amount agreed upon at the time may therefore be lower than what was agreed upon in the covenant. The most sensible solution is to first check what you were entitled to as a minor per year and to increase this amount with the parental contribution to student finance and to reduce it with your own annual income. What remains is the amount to which you are in principle 'entitled'. If you and your father cannot reach an agreement, then you will indeed have to go to court. You will need a lawyer for this procedure. You may be eligible for subsidized legal aid. You can contact one of the lawyers on this website, a legal aid shop or law shop in your area or Het Juridisch Loket (0900 8020) or: http://www.juridischloket.nl/Pages/default.aspx
